Building Control (Amendment) (No. 2) Regulations SI 365 2015

 

As a result of a review of Building Control (Amendment) Regulation S.I. No. 09 of 2014 by the Minister of State at the Department of the Environment, Community and Local Government, a second Amendment was introduced: Building Control (Amendment) (No. 2) Regulations S.I. 365 2015.



This second Amendment incorporates a 'Declaration of Intention to opt out of Statutory Certification'.  The signing of this Declaration allows for the removal of the mandatory requirement to provide statutory certificates of compliance in respect of a new dwelling on a single unit development or a domestic extension, thus, opting out of the general requirement to have the dwelling/extension designed, inspected and certified by a registered construction professional (Assigned Certifier).  The building inspections will be carried out by the Local Authorities instead.

 


The differences between the Statutory Certification (SI 09 2014) process and the alternative process now available (SI 365 2015) is outlined in Table 1 of the 'Information note for Owners of New dwellings and extensions who opt out of Statutory Certification for building control purposes' prepared by the Environment, Community and Local Government.

 

 

If choosing to opt out of providing statutory certificates of compliance the 'Declaration of Intention to opt out of Statutory Certification' signed by the Building owner must accompany the documents submitted to the building control authority when notifying them that works are about to commence.
